Last updated: 28 September 2026
These Terms & Conditions of Trade (“Terms”) apply to goods and services supplied by Premium Marine Products Pty Ltd t/a Ozzi Marine (“Ozzi Marine”, “we”, “us”) to the customer (“Customer”, “you”).
By placing an order, accepting a quotation, using a trade account or requesting supply from Ozzi Marine, you agree to these Terms.
All orders are subject to acceptance by Ozzi Marine.
Prices are as stated in our quotation, order confirmation or invoice and, unless stated otherwise, are exclusive of GST, freight and other applicable charges.
Once accepted, an order may only be cancelled or changed with our agreement. Special-order, custom-made, specifically procured or cut-to-length goods cannot generally be cancelled or returned unless agreed by Ozzi Marine or required by law.
Where a Customer requires a particular certification, classification, testing standard, material specification or other technical requirement, that requirement must be communicated to Ozzi Marine before the order is accepted.
Payment must be made by the due date stated on the invoice.
Unless approved credit terms have been established, Ozzi Marine may require payment in full before dispatch.
If an account becomes overdue, Ozzi Marine may, subject to applicable law, suspend further supply, place the Customer’s account on hold, withdraw or review credit terms, require payment before further supply and recover reasonable debt-recovery costs to the extent permitted by law.
Where an invoice remains unpaid for more than 30 days after its due date, Ozzi Marine may apply reasonable additional account administration, collection or debt-recovery charges associated with the overdue account, to the extent permitted by law. The Customer will be notified of any such charges applied to their account.
Any credit facility, credit limit or payment terms offered by Ozzi Marine may be reviewed from time to time. Ozzi Marine may decline further credit or require payment before further supply where an account is overdue or where the proposed supply would exceed an approved credit limit.
The granting of credit terms does not require Ozzi Marine to continue providing credit for future transactions.
Delivery dates are estimates unless expressly agreed otherwise. Ozzi Marine will use reasonable efforts to meet estimated delivery dates but is not responsible for delays outside our reasonable control.
Freight and delivery charges are payable by the Customer unless otherwise agreed.
Customers should inspect goods promptly after delivery and notify Ozzi Marine of any shortage, incorrect goods or visible freight damage as soon as reasonably practicable.
Where goods appear to have been damaged during transport, the Customer should retain the goods and, where reasonably possible, the original packaging and provide photographs of the goods, packaging and apparent damage so Ozzi Marine can investigate the freight claim.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law.
Risk in goods passes to the Customer upon delivery to the Customer or its nominated carrier, agent or delivery location.
To the extent permitted by law, ownership of goods remains with Ozzi Marine until those goods have been paid for in full.
Until ownership passes, the Customer must take reasonable care of the goods and must not intentionally damage, dispose of or otherwise deal with the goods in a manner inconsistent with Ozzi Marine’s ownership interest, except in the ordinary course of the Customer’s business.
The Customer acknowledges that these Terms may create a security interest in favour of Ozzi Marine under the Personal Property Securities Act 2009 (Cth) (PPSA), including in goods supplied by Ozzi Marine on credit or subject to retention of title.
The Customer agrees to provide information and assistance reasonably required for Ozzi Marine to register, maintain, perfect or enforce any security interest arising from these Terms.
Where applicable, Ozzi Marine may register its security interest on the Personal Property Securities Register.
Nothing in this section limits any rights or obligations that cannot lawfully be excluded or modified under the PPSA.
Returns for change of mind, incorrectly ordered goods or goods no longer required are subject to prior approval by Ozzi Marine.
Approved goods must be unused, undamaged, complete and in a condition suitable for resale.
Approved returns are subject to a 15% restocking fee, calculated on the original purchase price of the returned goods. The Customer is responsible for return freight, and original freight charges are non-refundable unless otherwise agreed or required by law.
Cut-to-length chain, special-order goods, customised products, electrical components that have been installed or connected, and products specifically procured for a Customer are not returnable for change of mind or incorrect selection unless Ozzi Marine agrees otherwise in writing.
The 15% restocking fee does not apply where goods are faulty, incorrectly supplied by Ozzi Marine or where the Customer is otherwise legally entitled to a remedy.
Nothing in this section limits the Customer’s rights under the Australian Consumer Law.
Marine equipment must be correctly selected, installed, operated, inspected and maintained for its intended application.
The Customer is responsible for providing accurate vessel, equipment and application information when requesting product recommendations.
Recommendations made by Ozzi Marine are based on the information provided by the Customer. Ozzi Marine is not responsible for incompatibility resulting from incorrect or incomplete information supplied by the Customer, except to the extent liability cannot lawfully be excluded.
Products must be installed and used in accordance with manufacturer instructions and, where appropriate, by suitably qualified persons.
For products including anchor chain, windlasses and gypsies, nominal chain diameter alone does not necessarily determine compatibility. Link pitch, internal and external link dimensions, link width, manufacturing standard, chain grade and other dimensions may be critical to correct operation.
Customers must confirm compatibility with the relevant equipment manufacturer’s specifications before installation.
Incorrect, incompatible, damaged or excessively worn gypsies, chain wheels, bow rollers, swivels, shackles or other associated anchoring equipment may cause abnormal or accelerated chain wear, poor operation or damage.
Damage caused by incompatible, excessively worn, incorrectly adjusted or incorrectly installed associated equipment is not covered by Ozzi Marine’s express product warranty to the extent that such equipment caused or contributed to the damage.
Anchor chain and associated anchoring components are subject to wear and must be regularly inspected and maintained having regard to vessel use, operating conditions, environmental exposure and manufacturer recommendations.
Customers should regularly inspect anchor chain for signs of corrosion, excessive wear, link deformation or elongation, damaged or distorted links, deterioration or loss of galvanising, abnormal surface condition or any other indication that the chain may no longer be suitable for continued service.
Where reasonably practicable, anchor chain should periodically be laid out and inspected along its full length, including sections that ordinarily remain within the chain locker.
Associated equipment including the windlass, gypsy, bow roller, swivel, shackles and connecting hardware should also be inspected, as worn, damaged or incompatible equipment may cause accelerated or abnormal chain wear.
Any chain showing significant deterioration, deformation, damage or other indications that its integrity may be compromised should not continue to be used until appropriately assessed.
Depending on vessel use and anchoring practices, periodically end-for-ending the anchor chain may assist in distributing wear more evenly and extending its useful service life.
Failure to reasonably inspect or maintain a product may affect an Ozzi Marine express warranty where that failure caused or contributed to the relevant damage or defect.
Nothing in this section excludes or limits any rights or remedies available under the Australian Consumer Law.
Where goods are intended for use on a surveyed vessel, classed vessel, commercial vessel or another regulated application, the Customer must advise Ozzi Marine of any applicable certification, classification society, survey, insurance or regulatory requirements before ordering.
The Customer must not assume that a product satisfies a particular survey, class, insurance or regulatory requirement solely because of its chain grade, material, testing, certification or published specification.
Unless Ozzi Marine expressly confirms otherwise in writing, responsibility for determining whether a product satisfies the requirements of the relevant surveyor, classification society, insurer, regulator or other authority remains with the Customer.
Products supplied by Ozzi Marine may be covered by an Ozzi Marine and/or manufacturer’s warranty.
Ozzi Marine will reasonably assist Customers with legitimate warranty claims and may require supporting information, photographs, inspection of the product, maintenance records, installation details, usage information or testing where reasonably necessary to assess a claim.
The express warranty periods below apply in addition to any rights the Customer may have under the Australian Consumer Law.
Unless otherwise stated in writing, galvanised anchor chain supplied by Ozzi Marine is provided with an express warranty against manufacturing defects for a maximum period of 12 months from the date of purchase.
Where the chain is installed on a vessel used as a liveaboard or is otherwise subject to continuous or unusually high levels of use or exposure, the express warranty period is 6 months from the date of purchase.
This express warranty does not cover normal wear and tear, deterioration or loss of galvanising arising from normal use, corrosion caused by environmental conditions, improper storage, misuse, incorrect installation, incompatible equipment, lack of maintenance, chemical exposure, electrical activity, stray current, electrolysis or damage caused by circumstances outside Ozzi Marine’s reasonable control.
These exclusions apply only to the extent that the relevant circumstance caused or contributed to the damage or failure.
Unless otherwise stated in writing, OMC 318LN Duplex Stainless Steel anchor chain is provided with an express warranty against manufacturing defects for 2 years from the date of purchase.
The express warranty does not cover damage or deterioration caused by misuse, incorrect installation, incompatible equipment, abnormal mechanical loading, chemical exposure, lack of maintenance, electrical activity, electrolysis, stray electrical current or other external environmental or vessel-related causes, to the extent that those circumstances caused or contributed to the relevant damage.
The cost of such testing will initially be the responsibility of the Customer, subject to any rights the Customer may have under the Australian Consumer Law.
To make a claim under an Ozzi Marine express warranty, the Customer should contact Ozzi Marine as soon as reasonably practicable after becoming aware of the alleged defect.
The Customer should provide proof of purchase, a description of the alleged defect or failure, photographs or video reasonably sufficient to show the condition of the product, details of the vessel, installation and associated equipment where relevant, information regarding the product’s use, inspection and maintenance where reasonably relevant, and any other information reasonably required by Ozzi Marine to investigate the cause of the alleged failure.
Ozzi Marine may require the product to be returned or made available for inspection before determining a warranty claim.
Where there is evidence, or Ozzi Marine reasonably suspects, that stray electrical current, electrolysis or another electrical issue may have contributed to deterioration or failure of the chain, the Customer may be required to arrange an inspection and electrical testing of the vessel by a suitably qualified marine electrician or other appropriately qualified person before the express warranty claim can be assessed.
Ozzi Marine may request a copy of the relevant test report or other reasonable evidence confirming the condition of the vessel’s electrical and bonding systems.
Customers should not dispose of, materially alter or repair a product that is the subject of a warranty claim without first giving Ozzi Marine a reasonable opportunity to inspect it, except where reasonably necessary for safety or to prevent further damage.
Where a claim is accepted under an Ozzi Marine express warranty, Ozzi Marine will, at its option and subject to applicable law, repair or replace the defective product or provide another appropriate remedy.
Where a product must be returned for assessment, Ozzi Marine will advise the Customer of the return procedure. Responsibility for freight, inspection and other reasonable expenses will be determined having regard to the outcome of the warranty assessment and any rights the Customer has under the Australian Consumer Law.
Warranty claims may be assessed having regard to the age and condition of the product, installation, inspection and maintenance, operating environment, frequency and nature of use, compatibility with associated equipment, electrical or electrolysis-related conditions where relevant, evidence of abnormal loading, wear or damage, and any other circumstances reasonably relevant to determining the cause of the reported issue.
Ozzi Marine reserves the right to inspect, or arrange for the inspection of, a product that is the subject of a warranty claim before determining the appropriate warranty response.
The existence or expiry of an Ozzi Marine or manufacturer’s warranty does not limit any rights or remedies that a Customer may have under the Australian Consumer Law.
Ozzi Marine’s express warranties are provided in addition to any rights and remedies available under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
The expiry of an Ozzi Marine or manufacturer’s express warranty does not necessarily mean that a Customer’s rights under the Australian Consumer Law have expired.
Where these Terms constitute or contain a warranty against defects for the purposes of the Australian Consumer Law, the applicable mandatory wording prescribed by the Competition and Consumer Regulations 2010 (Cth) must form part of the warranty documentation provided to the Customer.
Ozzi Marine takes reasonable care to ensure product descriptions, photographs, dimensions and specifications are accurate.
Manufacturers may change specifications, designs, components or packaging without notice where permitted by law.
Customers requiring a particular dimension, chain standard, material, certification, test certificate, classification approval or other specification must communicate that requirement to Ozzi Marine before ordering.
Product descriptions, testing information and certifications relate to the particular products, batches or specifications to which they are stated to apply and should not be interpreted as certification for an application for which they were not issued.
Where a particular certification, test report or supporting document is essential to the Customer’s intended application, the Customer should obtain confirmation from Ozzi Marine before ordering.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
Subject to those rights and to the extent permitted by law, Ozzi Marine is not liable for indirect or consequential loss arising from the supply, installation or use of goods or services.
Where permitted by law, Ozzi Marine’s liability will be limited in the manner permitted by applicable law.
Nothing in this section is intended to exclude liability where doing so would be unlawful.
Ozzi Marine is not responsible for delays or failure to supply caused by circumstances outside our reasonable control, including shipping or port delays, supply-chain disruptions, natural disasters or severe weather, industrial action, government restrictions, transport interruptions, international shipping delays, or supplier or manufacturing delays outside Ozzi Marine’s reasonable control, subject to applicable law.
Where such an event occurs, Ozzi Marine will use reasonable efforts to minimise the impact on the Customer and resume supply when reasonably practicable.
Ozzi Marine may update these Terms from time to time. Updated Terms apply to future transactions and do not retrospectively change an existing agreement unless agreed or permitted by law.
If a quotation, order confirmation or separate written agreement expressly varies these Terms, the expressly agreed variation will prevail to the extent of any inconsistency.
A failure or delay by Ozzi Marine to exercise a right under these Terms does not constitute a waiver of that right.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed or read down to the minimum extent necessary, and the remaining provisions will continue to apply.
These Terms are governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of Queensland and any courts competent to hear appeals from those courts.
